Haitian groups say video game violates hate-crime laws

WEST PALM BEACH -- Charging that the video game Grand Theft Auto: Vice City violates Florida's hate-crime laws, local Haitian groups refiled a lawsuit Friday in state court against the controversial game's maker, stores that sell it and their managers.

The Haitian groups make the claim because the game specifically says, "Kill the Haitians" and "Kill the Cubans." Those comments violate Florida's hate-crime laws, said Attorney Barry Silver, who filed the lawsuit.

"The game poses a threat to people of those ethnic groups," Silver said.

In addition to Rockstar Games Inc. and its parent company, Take-Two Interactive Software, the lawsuit names Wal-Mart, Sony Computer Entertainment, Microsoft, Target and Best Buy as defendants. It also names as defendants the managers of the Wal-Mart and Target stores on State Road 7 west of Boca Raton and the manager of the Best Buy store on Congress Avenue in Boynton Beach.

In December, Silver filed the initial lawsuit on behalf of the Haitian American Coalition and the Haitian American Community Council, both of Delray Beach; and a Boston-based Haitian civil-rights group. But New York-based Rockstar, which makes the game, had the lawsuit moved to federal court because none of the defendants was located in Florida.

After voluntarily dismissing the federal lawsuit, Silver and his clients refiled the case in state court to take better advantage of Florida laws. According to Silver, this complaint lists more defendants and ties its claims to violations of Florida law.

For example, the suit alleges that the game violates Florida law protecting children from being exposed to sexual and violent images, Silver said.

"They simulate sexual activity in the game," he said. "They portray the link of sex and violence as entertainment and fun."

The lawsuit seeks to have the game removed from stores and a possible recall of games that have been sold, Silver said. If that can't happen, Silver would settle for a large warning on the game explaining its violence and sexuality.

The only monetary damages being sought are for attorneys' fees, Silver said.

This has been going for a few months now. Someone will come to there senses and notice it's a game.

Nah, I doubt that. Not in this uppity, yuppie filled culture. They allow it on TV but heaven forbid it appears in a game.

The funnyest lawsuit i've seen was for the Sopranos.
In the Sopranos the mobsters are Italian. All the Italian-Americans got upset saying thay where stereotyped as the Mafia.
Funnyest load of crap ever.

Next there will be a lawsuit saying Australians are stereotyped as happy neighbours :p

I still find it funny, that we go from an opressed society where minorities, are the opressed, and were prosecuted for the smallest little thing. Now we are saying we want to become, and open culture, by removing oppression, but instead we prosecute anyone for the smallest little racist remark.

We go from oppressing the minority, to oppressing the majority. It's a very sad thing. I'd say more, but I'd be immediately be branded a racist, so I don't want to even start.

I consider racism to be the purposeful insulting of another race.
Maybe that should go in the Board Guidelines...
