Well not HAVE to, but thats the trend so far.
If they;re not selling it anymore in any form whatsoever, while they still hold the copyright, and CAN sue, it de facto becomes abadonware. And yes, they will win court cases, but in reality, it would be a truly ultimate dick move, as they are to gain nothing, and they'll lose in the court of public opinion, as they have no mechanism where people can buy it legally anymore.
Its just easier to release as freeware as was already done. But I think it would have been a lot more helpful to release the source code as well. Then something like Syringe/Ares could have been implemented years ago, and much easier.
Its actually kinda funny, the whole EA take on the CNC community is that its over. Yes, there's Victory Games, but no one knows what they are upto. I think EA is more focused on other tasks atm, like the BF3/MW3 war. I suppose no wonder the CNC community is dying - total neglect.
As for LaunchBase - why come up with it if no one is going to use it?
