Depends. It's okay to have sex with your partner, it's also okay to shoot a gun at a shooting range. However, it isn't legal to have sex with an infant, or to shoot a gun at a person.sex is legal but shooting ain't

As far as I see it, the fact is that Rockstar removed it from the game. Yes, it was hidden in the code but they decided they didn't want it to be part of the final game so they locked it out. As such they haven't been selling a game with sex scenes in it.
Or to put it another way, I can download a thousand mods that'll make game characters run around in the nud. Should that be taken into accoutn when deciding a game rating? Heck no. It's not like there's anyone telling me I have to download said patches, is there? Hence I don't downlaod them. Double standards is what it is. Sex is totally natural, yet it's considered to be unsuitable to appear in games. Killing people with man-made weapons is unnatural and ilegal but it can get into a game considered suitable for kids?
