For my first RTS I've been thinking about what it should be about. Since I've coded BFME for a while now, LotR sounds good. This is gonna be a completely new game engine, based off BFME and the hobbit, as well as LotR. EA finally seem to have got the idea of what we want, but this game's gonna show EXACTLY what we want. Post ideas for structures, units, heroes, races etc. I'm also recruiting a team of people to do modelling and skinning. I can do animation. So far the races are neutral, rohan, gondor, mordor, isengard, elves, dwarves,hobbits & rangers, goblins.

-Change the faction names
-Don't base it on LOTR
OR
-Make a mod, not a new game
Why is this?
Well if you make a new game based on LOTR, you will face the lawyers of EA. They will write to you and tell you to stop working on it or face a massive lawsuit. I highly doubt you could afford the legal costs and would ultimately arrive at the same answer, your game never being released.
Other than that, good luck.

I really don't think anyone will care if I'm not making any money from it. If they do then the programming's very moddable. Very easy to change from one to another.

you won't make cash out of it, but you could make them lose cash from competition between your game and BFME II
they own the right, you lose either way
change the names slightly, make reference to JRR Tolken, and not Tolkien, the name of the game could be : The Master of the Rings : Wars of the 3rd Age instead of LotR
just by changing slightly some things, you end up not infringing on any copyright

Let's say I make GT Chocolate bars. Now, I sell my "GT Choco Bars" for $1 each. Now, you make some chocolate bars and also call them "GT Choco Bars" but you sell them for free because your kind and generous. Now, people think your "GT Choco Bars" are my "GT Choco Bars" and take yours instead of buying mine. I lose money because people aren't buying my choco bars. I sue you for using my name on your choco bars, I get back my lost earning. However, sell them as "Twiceover Choco Bars" and there's no problem.
Understand?
This has been discussed once already with a R:TW mod for LOTR. You WILL be shut down UNLESS you change the name and do not base it on LOTR. Just because the game will be free, and just because it will reach probably only a very small audience, it will face the same fate.
